ROBERT PETERSEN

Experience

Robert represents banks, lenders, and financial institutions in complex lending and real estate transactions. He focuses his practice on the preparation of commercial loan documentation and guiding lenders through all phases of secured lending transactions, from structuring and underwriting through closing.


Robert is licensed to practice law in both Texas and California and plays a key role in the firm’s expanding lending practice serving financial institutions operating in both states.


Robert has extensive experience representing lenders in transactions involving a wide range of collateral, including commercial real estate, construction projects, business assets, and mixed-use developments. His work regularly involves financing for projects such as retail shopping centers, medical and industrial buildings, gas stations, hotels, townhome developments, and other commercial properties.


As part of the firm’s banking and lending practice, Robert prepares and negotiates the full suite of loan-closing documentation, including promissory notes, deeds of trust, loan agreements, UCC filings, subordinations, SNDAs, tenant estoppels, and other security instruments necessary to protect lender interests. He also works closely with lenders to review title commitments, address title issues, and structure transactions to ensure proper collateralization and enforceability.


In addition to his legal practice, Robert serves as an Escrow Officer with Chicago Title and is involved with the day-to-day escrow operations for the Firm’s Chicago Title real estate transactions. This dual role provides clients with a seamless closing process by integrating legal oversight with escrow administration and title coordination.


Robert’s combined experience in lending, real estate transactions, and escrow operations allows him to provide practical, business-focused solutions to banks, lenders, and real estate investors navigating complex financing transactions.


Earlier in his career, Robert represented businesses, lenders, and investors in commercial litigation and real estate disputes, including matters involving construction, creditor rights, and financial services litigation.

REPRESENTATIVE CASES

  • Represents lenders in hundreds of commercial financing transactions involving retail centers, industrial properties, hotels, and mixed-use developments.
  • Prepares and negotiated hundreds of comprehensive loan documentation for construction loans, SBA loans, and commercial real estate financing.
  • Advises lenders on title review, collateral protection, and loan structuring to secure real estate and business assets.
  • Represents lenders and mortgage servicers in matters involving title issues, foreclosure proceedings, debt workouts, and loan enforcement.
  • Successfully represented a client in mortgage litigation before the Texas Supreme Court resulting in the reversal of prior legal precedent.
